Nebraska Eviction Notice Requirements
Under the Nebraska Uniform Residential Landlord and Tenant Act, a landlord may end a tenancy for unpaid rent if the tenant does not pay within 7 calendar days after written notice of nonpayment. For other material lease violations, the notice must state that the agreement ends in 30 days unless the problem is fixed within 14 days. A month-to-month tenancy can be ended with written notice given at least 30 days before the next rent day.
The notice should be in writing, describe the unpaid rent or the violation, and state the landlord's intention to terminate if the problem is not corrected in time. Deliver it in a way you can prove, such as personal delivery or mail, and keep a dated copy. Nebraska also allows a separate 5-day notice, with no right to cure, for certain violent criminal activity, illegal drug sales, or other conduct that threatens health or safety.
If the tenant does not pay, cure, or leave by the deadline, the landlord may file a complaint for restitution of the premises in county or district court. Trial is held 10 to 14 days after the summons is issued, and the tenant can appear and respond. A Nebraska landlord may not lock out the tenant or interrupt electric, gas, water, or other essential services instead of going to court, and a tenant who is unlawfully removed can recover three months' rent as damages.

Nebraska: common questions
How long does a Nebraska tenant have to pay late rent after notice?
Seven calendar days. Under section 76-1431, if rent is unpaid when due, the landlord can give written notice that the rental agreement will end unless the rent is paid within seven calendar days. If the tenant pays in full within that time, the landlord cannot end the rental agreement for that nonpayment.
What notice is required for a lease violation in Nebraska?
The landlord gives written notice describing the violation and stating that the agreement will end at least 30 days after the tenant receives it unless the breach is fixed within 14 days. If the tenant fixes it, the tenancy continues. A repeat of substantially the same violation within six months allows termination on 14 days' notice.
How much notice ends a month-to-month lease in Nebraska?
At least 30 days' written notice, given before the periodic rental date named in the notice. The notice should state the date the tenancy will end, and the tenant must leave by that date or the landlord can file in court.
Where are Nebraska eviction cases filed?
Eviction cases, called actions for restitution of the premises, are filed with the clerk of the county or district court. The tenant receives a summons, and trial is held 10 to 14 days after the summons issues before any writ is issued.
