How to contest a parking ticket in San Jose

Parking tickets in San Jose are handled by the City's Office of Parking Violations within the Department of Transportation. A ticket must be paid or contested within 21 days of the issue date. If it is not, a reminder notice is mailed to the registered owner, and tickets not handled by the deadline incur extra penalties and can no longer be appealed.

The first level is a free administrative review. You can contest online through the City's citation website, in person at the Office of Parking Violations at 210 N. 4th St., or by mail to P.O. Box 11023. Explain why the citation was issued in error and include copies of supporting documents, your citation or notice, your full name and a complete mailing address. Documents are not returned.

If the review finds you liable, you can request an administrative hearing in person or in writing within 21 calendar days of the mailed result. You must pay the full citation amount first, unless you request a penalty waiver after completing the review. The third level is a civil appeal to the court within 30 calendar days of the City's final decision, with a filing fee that is refunded if you win.

What to do, step by step

  1. Check the deadline

In San Jose you generally have 21 days from the ticket date to contest it. Missing it can add late penalties.

  2. Gather your evidence

Photograph the signs, curb markings, meter or pay station, and where your car was parked. Keep receipts, permits and any repair or police records.

  3. Write your appeal

Answer the questions above. Keep it short and factual — reviewers read a lot of these, and a calm, specific letter with evidence is the most persuasive.

  4. Submit it on time

Submit online through City of San Jose Office of Parking Violations, or mail it to P.O. Box 11023, San Jose, CA 95103-1023. Keep a copy and proof that you sent it.

  5. Follow up

If the administrative review finds you liable, you can request an administrative hearing within 21 calendar days of the mailing of the result, and you must pay the full citation amount first unless you qualify for a penalty waiver. The hearing decision can be appealed to the court within 30 calendar days.

What if your appeal is denied?

A denial at the first review isn't the end. Most cities offer at least one more level — usually a hearing in person, by phone or by mail — where a different person looks at your evidence.

In San Jose: If the administrative review finds you liable, you can request an administrative hearing within 21 calendar days of the mailing of the result, and you must pay the full citation amount first unless you qualify for a penalty waiver. The hearing decision can be appealed to the court within 30 calendar days.

Keep every notice and receipt. If you win at a later stage, any amount you paid is normally refunded.

Re: Request for review of parking citation 4012345678 — license plate 7XYZ442

To whom it may concern:

I am writing to contest parking citation 4012345678, issued on September 20, 2026 at 300 block of Main St to the vehicle with license plate 7XYZ442. I respectfully ask that the citation be dismissed.

Reason for contesting: The signs were missing, unclear or blocked.

The only no-parking sign on the block was covered by overgrown tree branches. Photos I took a few minutes after finding the ticket show the sign could not be seen from where I parked.

I have included the following evidence in support of this request: Two dated photos of the covered sign and a map showing where my car was parked.

I am requesting an administrative review within the 21 days allowed for contesting a citation in San Jose, by the deadline of October 11, 2026.

Please review this citation and dismiss it. I would appreciate written confirmation of your decision, sent to the address above.

Sincerely,

Alex Morgan

Frequently asked questions

How long do I have to contest a San Jose parking ticket?

A San Jose parking ticket must be paid or contested within 21 days of the issue date. After that, extra penalties are added and the ticket is no longer eligible for appeal. A reminder notice is mailed to the registered owner if a ticket is not handled within 15 days.

Where do I mail a San Jose parking ticket contest?

Mail your written contest and copies of supporting documents to City of San Jose Office of Parking Violations, P.O. Box 11023, San Jose, CA 95103-1023. Include your citation or reminder notice, your full name and a complete mailing address, including any apartment or suite number.

Do I need to pay before contesting in San Jose?

No payment is needed for the administrative review, and anything you paid is refunded if you are found not liable. For the second-level administrative hearing, the full citation amount must be paid first, unless you have asked for a waiver of the penalty after completing the review.

What is the final step if I lose my San Jose hearing?

You can file a civil appeal with the court in the jurisdiction where the citation was issued within 30 calendar days of the mailing of the City's final decision. The court charges a filing fee, which is refunded along with the citation amount if you win.

Is it worth contesting a parking ticket?

If you have a genuine reason and some evidence — a hidden sign, a broken meter, a valid permit or a ticket with wrong details — a written appeal costs little and succeeds often enough to be worth the few minutes it takes.

What evidence helps the most?

Clear, dated photos of the signs, curb and meter; payment receipts or permits; and anything showing the ticket's details are wrong, such as the wrong plate or vehicle make.
