[Who owes you the money]
Re: Final demand for payment of [Amount owed ($)]
Dear [Who owes you the money],
I am writing to formally request payment of [Amount owed ($)] that you owe me.
Nature of the debt: Unpaid rent or shared expenses.
[What the money is for]
Payment was due on [When payment was originally due]. As of the date of this letter, I have not received it, and the full balance of [Amount owed ($)] remains unpaid.
Please pay [Amount owed ($)] in full no later than [Your final payment deadline]. You can pay as follows: [How they should pay you]
If you believe you do not owe this amount, or you dispute any part of it, please tell me in writing before that date and explain why. If you cannot pay the full amount at once, contact me before the deadline to propose a written payment plan.
If I have not received payment, or a written proposal I agree to, by [Your final payment deadline], I intend to file a claim in small claims court to recover the amount owed, plus court costs and any other amounts the court allows.
I would prefer to settle this without going to court. I am keeping a copy of this letter and proof that I sent it.
Sincerely,

Show the agreement to share costs
If you are both on the lease, include the lease dates and the monthly rent. Then show how you agreed to split it, through texts, a roommate agreement or a history of payments. If only you signed the lease, your agreement with the roommate is still important evidence.
List each month and bill separately with the amount owed, and include proof that you paid the full amount yourself, such as bank records or the landlord's receipts.
Leases and moving out
When two people sign a lease together, each is often responsible to the landlord for the full rent, not just their half. That is why you may have had to cover the whole amount. A roommate who leaves early generally does not escape their share just by moving out, but your agreement and lease terms matter.
If a replacement roommate moved in or the landlord re-rented the room, account for that in your amount. Asking only for what you actually lost makes your claim more credible.
Security deposit and other offsets
If the roommate paid part of the security deposit, think about how it will be handled when the lease ends. Some roommates agree that unpaid rent comes out of their share of the deposit; put any such agreement in writing.
Small claims court handles many roommate disputes. Keep your letter, the lease, payment records and messages together in case you need to file.
What to do, step by step
Gather the paperwork
Collect the invoice, contract, loan note, returned check, texts or emails that show what was agreed, how much is owed and when it was due.
Fill in your details
Answer the questions above. Stick to facts and numbers — the amount, what it's for, the original due date and a firm new deadline.
Send it with proof of delivery
Mail the letter by certified mail with return receipt, and email a copy if you normally communicate that way. Keep a copy of everything you send.
Wait for the deadline
Give the other side until the date in the letter. If they offer a payment plan, get it in writing before you agree.
File in small claims if needed
If the deadline passes with no payment, you can file in small claims court in the county where the debtor lives or where the deal was made. Bring this letter and your proof of mailing.
What if they still don't pay?
An ignored demand letter still does its job: it creates a dated record that you asked for the money, explained what it was for and gave a reasonable deadline. Small claims judges routinely ask whether you tried to collect before suing, and this letter answers that question.
Small claims court is built for people representing themselves. Filing fees are modest, forms are short and hearings are informal. Each state sets its own dollar limit, so check your county court's website — if the debt is above the limit, you can usually choose to waive the excess and still use small claims.
Winning a judgment is not the same as being paid, but it gives you tools such as wage garnishment or a bank levy that most debtors want to avoid. Many people pay once they receive notice of a court date.

Re: Final demand for payment of $2,242.00
Dear Lauren Whitaker,
I am writing to formally request payment of $2,242.00 that you owe me.
Nature of the debt: Unpaid rent or shared expenses.
We both signed the lease for 27 Harbor Rd, Apt 4, and agreed by text to split the $2,100 monthly rent and the utilities equally. You moved out on July 31 without notice and have not paid your half of the August and September rent, $2,100 in total, or your share of the electric and internet bills for those months, $142. I paid the full amounts to avoid a late fee and eviction.
Payment was due on September 1, 2026. As of the date of this letter, I have not received it, and the full balance of $2,242.00 remains unpaid.
Please pay $2,242.00 in full no later than October 30, 2026. You can pay as follows: By Venmo or Zelle to my phone number, or by check mailed to the address above.
If you believe you do not owe this amount, or you dispute any part of it, please tell me in writing before that date and explain why. If you cannot pay the full amount at once, contact me before the deadline to propose a written payment plan.
If I have not received payment, or a written proposal I agree to, by October 30, 2026, I intend to file a claim in small claims court to recover the amount owed, plus court costs and any other amounts the court allows.
I would prefer to settle this without going to court. I am keeping a copy of this letter and proof that I sent it.
Sincerely,
Priya Shah
Frequently asked questions
Can I sue a roommate for unpaid rent?
In many cases, yes, usually in small claims court. You will need to show that you had an agreement to share rent and that you paid their share. Texts, a roommate agreement and bank records are typical evidence.
What if my roommate wasn't on the lease?
You can still ask them to pay what they agreed to. Your evidence will be your arrangement with them, such as texts and past payments. The landlord generally cannot collect from someone who did not sign the lease, but you may be able to.
Can I include utilities and other shared bills?
Yes. List each bill, the month, the total and their share. Include only bills you agreed to split, and keep copies of the bills and your payments.
Is a demand letter for payment legally required before suing?
Not always, but many small claims courts expect you to have asked for payment first, and some types of claims, such as bad checks in many states, have a written-demand step before extra damages become available. A clear letter is the easiest way to show you tried to resolve the debt.
How long should I give them to pay?
Ten to fourteen days is common and looks reasonable to a judge. Shorter deadlines can seem unfair unless the debt is long overdue. Pick a specific calendar date rather than a number of days so there is no confusion about when the deadline passes.
