Late Rent Notice With Late Fee — Free Template for Landlords
A late rent notice with a late fee reminds the tenant that rent is overdue and that the late fee in their lease now applies. Spelling out the fee in writing avoids surprises and disputes later. Late fees must be in the lease, and some states cap them or require a grace period first, so check before you add one.

Make sure the fee is allowed
A late fee generally has to be written into the lease, and many states regulate it. Some cap the amount, some require it to be reasonable, and some require a grace period of several days before any fee can be charged. Check your lease and your state's rules, and don't charge more than both allow.
Cite the lease section in the message box so the tenant can see where the fee comes from.
Show the numbers clearly
The notice lists the rent past due and the late fee separately, so the tenant can see both amounts. Give a pay-by date and payment instructions. If the lease adds daily fees, describe how they work rather than guessing a running total.
Apply payments the way your lease says. If it doesn't say, many landlords apply payments to rent first, which keeps the rent itself current.
Be flexible when it helps
Waiving a late fee once for a reliable tenant can build goodwill, but put the waiver in writing so it isn't seen as a change to the lease. If the rent stays unpaid and you later serve a formal notice to pay rent or quit, remember that many states only allow rent, not fees, in that notice.
What to do, step by step
Check the lease and your ledger
Confirm the rent amount, due date, any grace period and late fee in the lease, and check your records to make sure the payment really hasn't arrived.
Choose the right tone
Start with a friendly reminder. Use a second or final notice only if earlier reminders haven't worked.
Fill in the notice
Answer the questions above with the amount past due, the due date, a reasonable date to pay by and clear payment instructions.
Send it and keep a copy
Deliver it by email, mail or hand as your lease allows, and keep a copy with the date sent.
Follow up
If the rent still isn't paid, talk to the tenant, consider a written payment plan, and check your state's rules before taking any formal step such as a pay or quit notice.
What if the tenant still doesn't pay?
Most late rent is resolved with a reminder and a conversation. If the tenant doesn't respond, try a phone call or a second notice, and ask whether a short payment plan would help. Put any arrangement in writing with dates and amounts.
If the rent remains unpaid, the formal next step in most states is a written notice to pay rent or quit, which has its own notice period and rules set by state and sometimes local law. That notice, not this reminder, is what usually comes before any court case. Our eviction notice template covers it.
Whatever happens, don't change locks, remove belongings or shut off utilities to pressure a tenant. Only a court can remove a tenant, and self-help measures are illegal in nearly every state.

Frequently asked questions
How much can I charge as a late fee?
It depends on your lease and state. Some states cap late fees at a dollar amount or a percentage of rent, others require them to be reasonable, and some require a grace period first. Check your state's rules.
Can I add a late fee if it's not in the lease?
Generally no. A late fee is usually enforceable only if the lease provides for it. You can add one when the lease is renewed or, for month-to-month tenancies, with proper notice of the change.
Can I deduct unpaid late fees from the security deposit?
In many states, deposits can cover unpaid amounts owed under the lease, which may include valid late fees. Rules vary, so check your state's security deposit law before deducting.
Is a late rent notice the same as an eviction notice?
No. A late rent notice is a reminder that rent is overdue. An eviction notice, such as a notice to pay rent or quit, is a formal notice with legal requirements that can lead to a court case. Many landlords send a reminder first.
When should I send a late rent notice?
After the due date and any grace period in the lease have passed. Many landlords send a friendly reminder a few days after the due date, then a second notice a week or so later if needed.
